RIGHT TO INFORMATION

Right to Information Act, 2005

 

Right to Information Act-2005, aims to provide set out the practical regime of Right to Information for citizens to secure access to information under the control of Public authorities, in order to promote transparency and accountability in the working of every public authority.


Who can request for information ?

Any citizen can request for information by making an application in writing or through electronic means.


How to make a request for information under the RTI Act?

The format of application for Information under Right to Information act - 2005 is as per the Extraordinary Kerala Gazette notification No.11259/Cdn.5/2006/GAD dated 9/5/2006 of General Administration (Co-ordination) department, Government of Kerala.

Apply in writing or through electronic means in Malayalam or English together with the prescribed fees to the Public Information Officer of the Company.


Mode of Payment of Fees under Right to Information Act, 2005

Sub-rule (a) (i) of Rule 2 of the Kerala Right to Information (Regulation of Fee and Cost Rules), 2006 issued under GO (P) No. 540/2007/GAD dated 18.12.2007 and published in the Extraordinary Gazette No. 2290 dated 22.12.2007 is amended vide Extraordinary Gazette No. 1131 dated 03.06.2008, as follows:

“provided that in the case of public authorities other than the Government Departments, the fee shall be remitted to the account of such public authority as provided in clauses (c) and (d) ”.

Clauses c & d are specified as follows:
c) by cash remittance against proper receipt in the Office of the Public Information Officer/Assistant Public Information Officer as the case may be,
or
d) by Demand Draft/Bankers Cheque/Pay Order.

In view of the above Government Order, it is hereby informed that applications under Right to Information Act will only be accepted with application fee as per clause (c) and (d) of Rule (3) of the Right to Information (Fee and Cost Rules) 2006.

As per the order of Government of Kerala vide GO(P) No.540/2007/GAD dated 16.12.2007 & Circular No.CDN5/93/2023-GAD dated 13.07.2023, the fee can also be remitted to the following bank A/c directly, and the proof shall be attached alongwith the application.

Hence, various fees under Right to Information Act may be remitted in KTDFC by Cash or by  Demand Draft/ Bankers Cheque/ Pay Order drawn in favour of KTDFC payable at Thiruvananthapuram, or remitted directly into above bank A/c Fees paid through any other mode will not be accepted, as per the above directions.


Fee for providing information

In case it is decided to provide the information, the requester shall be informed of the additional fees, if any, required to be deposited by him/her for the information sought and information shall be furnished after the deposit of the fee by the requester, as per the Act.

In accordance with directives given in the Gazette notification issued by Department of Personnel & Training, Ministry of Personnel, Public Grievances and Pension, Govt. of India, vide no. 34012/8(s)/2005-Estt.(B) dated 16.09.2005, for providing the information under sub-section 7, of the Act an additional fee at the following rates shall be charged


  • Rupees three for each page in ‘A4’ size paper.
  • Actual charge or cost price of the copy in larger size paper.
  • Actual cost or price for samples or models, maps, plans etc.
  • For inspection of records, no fee for the first hour; and a fee of rupees ten for every subsequent thirty minutes or fraction thereof.


Provided, that in the case of public authorities other than the Government Departments, the fee shall be remitted to the account of such public authority as provided in clause (c) and (d) of rule 3 of the Kerala Right to Information (Regulation of Fee and Cost Rules), 2006.


Up to 20 pages (A4 size) of documents, no fees shall be charged from person Below Poverty Line

As per the G.O.(P) No.20/2015/GAD dated 17.01.2015 of General Administration (Co-ordination) Department, persons below poverty line are exempted from payment of application fee and also the fee for providing the information. The Government of Kerala has authorized the Block Development Officers as the competent authority to issue the eligibility certificate to those below poverty line in rural areas and, the Secretary of the Corporation/ Municipality for those below poverty line in the Corporation / Municipal area.


Information is free if the time limit is exceeded

The information shall be provided free of cost where a Public Authority fails to comply with the prescribed time limit.


Information

According to Section 2(f) of the Right to Information Act, the  ‘information’ means ‘any material in any form’. A citizen under the Act has a right to get ‘material’ from a public authority which is held by or under the control of that public authority. The right includes inspection of work, documents, records; taking notes, extracts or certified copies of documents or records; taking certified samples of material; taking information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer or in any other device.

Thus, a citizen has a right to get the material, inspect the material, take notes from the material, take extracts or certified copies of the material, take samples of material, take material in the form of diskettes etc.

The PIO is required to supply such ‘material’ to the citizen who seeks it and does not require to deduce some conclusion from the ‘material’ and supply the ‘conclusion’ so deduced to the applicant. The PIO is required to supply the ‘material’ in the form as held by the public authority and is not required to do research on behalf of the citizen to deduce anything from the material and then supply.

Kerala Transport Development Finance Corporation Limited (KTDFC) is a Non Banking Financial Company fully owned by the Government of Kerala and having a valid certificate of registration issued by Reserve Bank of India under section 45-IA of the RBI Act, 1934.


KTDFC accepts deposits from the public with attractive interest rates through Periodic Interest Scheme-Monthly (PIPSM), Periodic Interest Scheme-Quarterly (PIPSQ) and Money Multiplier Scheme (MMS). The deposits are guaranteed by the Government of Kerala, which ensures 100% security and extra earnings.


KTDFC offers various loan products to suit the needs of every customer with low diminishing EMI rates, hassle-free procedures and premature closure options ensuring more savings to its customers.


KTDFC has successfully completed the construction of a Commercial cum Office Complex for Motor Vehicles Department at Vazhuthacaud, Thiruvananthapuram (Trans Towers) in 2006 and undertook the construction of Bus Terminal cum Shopping Complexes for KSRTC on BOT basis at Angamaly, Thiruvananthapuram, Thiruvalla and Kozhikode. Renovation of Tagore Theatre into a modern Cultural Complex, as a State-of-the-art venue of Cultural and Entertainment Activities has also been successfully completed by KTDFC.

Any citizen of India who desires to obtain any information under the Right to Information Act, 2005 may make a request in writing or through electronic means to the Public Information Officer or the Assistant Public Information Officer.


Appeal

In case the Requester who does not receive a decision within the time specified in subsection (1) of clause (a) of sub-section (3) of section 7 of the Act or is aggrieved by decision of the Public Information Officer, as the case may be, may within thirty days from the expiry of such period from the receipt of such a decision, prefer an appeal to the Appellate Authority for redressal of the grievance.

 xvii. Any other information

The information which is exempt from disclosure

The Act provides under sections 8 & 9, certain categories of information that are exempt from disclosure to the citizens. Any person desirous of obtaining information is advised to refer to the relative sections of the Act before submitting a request for information.


Assistance

Where the applicant cannot make the request in writing, the State Public Information Officer shall render all reasonable assistance to the person making the request to reduce the oral request into a written request. Persons below poverty line are not required to remit the application fee. However, they are required to produce BPL certificate from the Block Development Officer for those persons residing in rural areas and, from the Secretary of the Corporation/Municipality of those residing in the Corporation / Municipal area, respectively. An applicant is not required to give any reason for requesting the information or any other personal details except those that may be necessary for contacting him.


Time limit for Information

On receipt of a request for information, the Public Information Officer shall either give the information on payment of the prescribed fee or reject the request for any of the reasons specified in section 8 and 9 of the RTI Act as expeditiously as possible, and in any case within thirty days of the receipt of the request. Where the information sought for concerns the life or liberty of a person, the same shall be given within 48 hours of the receipt of the request. If the decision on the request for information is not given within the prescribed time limit, the request shall be deemed to have been refused. Where a decision is taken to provide the information on payment of the cost of providing the information, the Public Information Officer shall send intimation to the person making the request giving details of the fee representing the cost of providing the information and the calculation made to arrive at the amount, requesting him to deposit the fees. The period intervening between the dispatch of the above intimation and payment of fees shall be excluded for the purpose of maximum period in determining the time limit for providing the information.


Rejection of a request

Where a request is rejected, the State Public Information Officer shall inform the person making the request –

  • The reason for such rejection
  • Period within which the appeal may be preferred; and
  • The particulars of the Appellate Authority
